When you file a petition for divorce, you do it in state court, serving your spouse with a summons as you would in any other civil suit, and challenging him or her to respond to your complaint. Both sides need to supply the court with financial affadavits, and produce extensive documentation about assets and debt.
If a divorce is largely amicable and does not involve children, both sides may be able to reach a settlement agreement and file it with the court. You may file as "co-petitioners." In more complex and rancorous cases, however, there's much for a judge to decide.
At issue will be division of property, child custody, visitation arrangements, child support and spousal support. Calculating support payments is in itself a detailed process that relies on complex and often inflexible formulas. Property distribution will depend upon determinations about what is "separate" and "marital" property. Assets brought into the marriage and inheritances are usually considered to be separate, and are not divided between spouses.
